What You Need to Know About the Tenth Amendment

What is the one thing that everyone should know?

The answer to federal tyranny in the US is the Tenth Amendment of the Constitution!

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The Constitution was designed to limit the federal government and centralized power.  The Federal government has very limited power granted to it in Article 1, Section 8 of the Constitution.

Most people are unaware that both state and local (city and county) government power trumps federal power unless that power is specifically named in Article 1, Section 8. 

An example of this that is playing out right now with the feds' struggle and failure to control marijuana, which is illegal under federal law.  However, many states have legalized medical marijuana and now Washington state and Colorado have legalized the recreational use of marijuana.  The feds are desperate to maintain the illusion that the federal drug laws beat state laws, but the truth is that they need the complicity of the state and/or local governments to crack down on the activity.

State law is a higher authority than the Supreme Court when their rulings violate the Constitution.  California asserted its Tenth Amendment authority over legalizing medical marijuana when the state was sued in the Supreme Court by the federal government that considers marijuana to be illegal.  The Supreme Court unconstitutionally ruled in favor of the federal government.  California then ignored the ruling and continued to allow medical marijuana.  This is the first time that a state simply ignored the Supreme Court and it was backed by strong public support.

An example of local governments' superiority to the feds is the County Sheriff is the highest law enforcement agent within a particular county.  The sheriff can arrest federal agents in his county who break the law.  In fact, the feds have backed down in a few instances when sheriffs have threatened to arrest them if they interfered.


In fact, Sheriff Tony DeMeo of Nye County, Nevada was threatened by the USDA Forest Department- they said that they would arrest him and bring a SWAT team to remove cattle from a local rancher.  Sheriff DeMeo told the US Forest Department representative that he would meet their SWAT team with his own SWAT team.  The Feds stood down- it was an empty threat because Sheriff DeMeo had jurisdiction over this matter and was on solid ground with the Constitution.


The federal government will continue marching us toward tyranny until WE put a stop to it.

What can we do to enact the Tenth Amendment?

People can campaign for nullification of bad federal laws using the toolkit from the Tenth Amendment center that shows you how to educate, build support and coalitions and effectively lobby.  This valuable toolkit provides important step-by-step direction to launch a campaign and provides model legislation.

The good news is that more and more people are waking up to the Tenther solution- liberals and conservatives can work together on topics like nullifying the NDAA's provision for the indefinite detention of American citizens and ending the drug war through the legalization of marijuana.  Currently, these highly contested issues are being addressed by campaigns based on the Tenth Amendment Center's campaign toolkit- and many state are winning!


Instead of battling the enormity of the federal government, we can get involved in state and local politics to nullify bad federal laws and policies.
